Residential Foreclosures
The Problem
Due to the downturn in the economy, Casselberry residents have experienced an increase in properties being foreclosed on by mortgagees (lenders). As a result, many of these properties, both occupied and abandoned, have been neglected and are not being maintained according to Casselberry City Code.
What We Are Doing
In an effort to protect residential neighborhoods from becoming blighted and to maintain the security of abandoned and neglected properties, the City of Casselberry has established a Residential Foreclosure Registration Program. In addition, the Casselberry City Commission has enacted a new Casselberry Residential Property Foreclosure Ordinance.
Effective January 1, 2010, any mortgagee (lender) who holds a mortgage on real property located within the City of Casselberry shall be required to perform an inspection of the property upon default by the mortgager (home owner) and prior to the issuance of a notice of default.
Registration Requirements and Options
If the property is abandoned real property, within ten (10) days of the issuance of a notice of default, the mortgagee (lender) will be required to register the property with the Casselberry Police Department’s Code Enforcement Section. The registration must be on the forms provided by the City of Casselberry. The cost to register will be $100.00 per registered property. A registration is required for each abandoned real property in default.
If the property is NOT abandoned and in the process of formal foreclosure, the mortgagee is encouraged to register the property with contact information in order to mitigate any violations which may occur during the foreclosure process. Mortgagee (lender) registrations of occupied foreclosures will require NO registration fee.

Penalities for Non-Compliance
Failure of the recorded mortgagee (lender) and/or property owner to properly maintain the property may result in a violation of the City Code and the issuance of a citation or Notice of Violation/Notice of Hearing by a City's Code Enforcement Officer.
Pursuant to a finding and determination by the City's Code Enforcement Board, the City of Casselberry may take the necessary action to ensure compliance with this section. When property is found to be abandoned or neglected, City Code Enforcement Officers may bring a case against the mortgagee, property owner or both, even if the foreclosure process has not been completed.
More Information
A one-month grace period will be provided in order for properties in default to be registered, as well as to allow properties neglected to come up to code. Starting February 1, 2010, the ordinance will be enforced.
